JUDGMENT / ORDER

Learned Counsel for the applicant and A.G.A. are present. It is alleged that the complainant's son Gopal left the house with accused applicant Gulboo and Brajesh on 02.06.2009 and since then he did not come back to the house.
It is argued by the learned counsel for the applicant that the F.I.R. has been lodged on 24.03.2010 i.e. 9-10 months after alleged kidnapping. Moreover, there is no demand of ransom and it appears that the son of the complainant had left the house of his own.
I considered over the respective arguments. Looking to the inordinate delay in lodging the F.I.R., I feel that a case of bail is made out.
Let the accused-applicant Gulabo @ Gulab Singh be released on bail in case crime no. 11 of 2010, under section 364 I.P.C. and 3(2) (V) SC/ST Act, Police Station-Chitrahat, District-Agra, on his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the Court concerned.
