1. Heard learned counsel for the petitioner as well as learned Standing counsel for the State and Sri Sudhir Bharti for the Gaon Sabha.
2. After arguing at some length learned counsel for the petitioner submits that the entire controversy has been remanded by Additional Commissioner (Judicial), First Gorakhpur Region, Gorakhpur by order dated 6.10.2020 to the court of Sub Divisional Magistrate where the proceedings are pending. He submits that the respondents are continuously trying to evict the petitioner from the said premises.
3. Learned Standing counsel has submitted that the petitioner has efficacious remedy before the court of Sub Divisional Magistrate where the matter is pending and he has liberty to move an application for interim relief which can be suitably considered and decided by the court of Sub Divisional Magistrate for redressal of his grievances as raised in the present petition.
4. In light of the above, the petition is disposed of with direction that the partition suit pending the court of Sub Divisional Magistrate be decided within a maximum period of six months from the date a copy of this order is placed before him in accordance with law.
