The petitioner has instituted this writ petition for issuance of a writ of certiorari to quash the order passed by the District Deputy Director of Consolidation, Azamgarh.
It is stated that the second respondent has allowed the transfer application moved by the contesting respondents.
Sri S.C. Varma, learned counsel for the petitioner has very fairly submitted that as regards the discretion exercised by the District Deputy Director of Consolidation is concerned, no interference is may be made by this Court but a direction be issued to the first respondent to decide the revision himself.
Having due regard to the facts of the case, the writ petition is disposed of by issuing a direction to the first respondent to decide the revision without granting any unnecessary adjournment expeditiously, preferably within four months from the date of communication of this order. The first respondent shall not grant any adjournment without imposing a cost of not less than Rs. 500/-. He shall pay regard to the judgment of the Supreme Court in the case of Shiv Cotex v. Tirgun Auto Plast Pvt. Ltd and others, (2011) 9 SCC 678, wherein the Court has held that the parties have no right to seek more than three adjournments in a case.
With the aforesaid observations, the writ petition stands disposed of.
No order as to costs.
