Heard learned counsel for the petitioner; Shri Apurva Hajela, learned Standing Counsel for the State respondents and Shri Manoj Kumar Yadav, learned counsel appearing for the Gaon Sabha.
The petitioner is before this Court with request to issue direction to the Sub Divisional Magistrate, Tehsil Mugalsarai, District Chandauli to decide the application dated 29.9.2018 in the light of provision of Sections 22 and 23 of U.P. Revenue Code, 2006 within stipulated time.
Learned Standing Counsel fairly states that in case the application is still pending and has not been disposed of, the same shall be considered and decided expeditiously.
In view of the above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the respondent no.2 to consider and decide petitioner's aforesaid application dated 29.9.2018 by a speaking order within a period of three months from the date of production of a certified copy of this order before him.
