Heard learned counsel for the petitioner, learned Standing Counsel for respondent nos.1 to 3 and Sri B.P. Singh, learned counsel for respondent nos.4 & 5.
The petitioners are Assistant Teacher and have been posted in different Districts. The petitioners opted for voluntary transfer and on their request, they were transferred to District Sant Kabir Nagar. On being transferred to District Sant Kabir Nagar, their grade pay have been reduced to Rs.4200/- whereas at the earlier place of posting, their grade pay was Rs.4600/-.
The petitioners are aggrieved by reduction in grade pay which has resulted in reducing the salary of the petitioners. The petitioners in this regard have submitted representation to the respondent no.4.
Learned counsel for respondents no.4 & 5 submits that no useful purpose would be served in keeping the writ petition pending, and an appropriate direction be issued to respondent no.4 to consider the grievance of the petitioners.
Considering the facts and circumstances of the case, without going into merits of the case and with the consent of the parties, the writ petition is disposed of permitting the petitioners to file separate representation before the respondent no.4-Basic Shiksha Adhikari, Azamgarh raising all their grievances within a period of three weeks from today. In case any such representation is filed, the respondent no.4 shall consider and decide the same by a reasoned and speaking order within a period of two months thereafter.
With the aforesaid observations, the writ petition is disposed off.
