The petitioner is aggrieved by the notice dated 20 February 2018 issued by the National Highways Authority of India requiring the petitioner to remove the encroachment failing which appropriate action in accordance with law will be taken.
The petitioner claims to have submitted a reply on 9 March 2018. The sole relief pressed for by learned counsel for the petitioner at the time of hearing of the writ petition is that the objections filed by the petitioner may be considered before any action is taken.
Sri R.K. Jaiswal appears for respondent No.1. Sri Pranjal Mehrotra appears for respondent No.2 while the learned Standing Counsel appears for respondent Nos. 3 and 4.
Inasmuch as the petitioner has already filed a reply to the notice, we deem it appropriate to dispose of this petition with a direction to the Authority which had issued the notice dated 20 February 2018 to consider the reply filed by the petitioner before taking any further action in the matter.
The writ petition is, accordingly, disposed of.
