JUDGMENT / ORDER

When the matter was called out, Shri J. V. Japee, learned advocate for the petitioner submitted that he has received instructions from the petitioner that out of 97 workmen, most of the workmen have accepted settlement and resigned and they would not be entitled in pursuing the matter. The remaining workmen are absolutely negligible in number. However, this fact is required to be recorded with supporting documents. Shri L.N. Medipally, learned advocate for the respondent nos.1 and 2, has submitted that this is not correct instruction and all workmen are still interested in pursuing the matter. In view of this, time requested and the same is granted. The matter is adjourned to 3rd July, 2012. No further time is granted. The submissions have been canvassed at length in this matter.
