Mrs.
Soparkar, learned advocate, and Mr. A.A.Gandhi, learned advocate, have appeared today.
They have jointly submitted that in present matters, the Board of Industrial & Financial Reconstruct has also recommended that the company may be wound up. Mr. Gandhi, learned advocate, submitted that subsequently the OL has already issued advertisement pursuant to the Board's opinion. Therefore, subject to any other objections, which might have been received by the office of OL, final orders are now required to be passed in view of the Board's opinion.
Mr.
Gandhi, learned advocate, has also submitted that he has intimated his client (i.e. the respondent No.1) that he is retiring from the proceedings as advocate.
Today's cause list shows that the said respondent Nos.2 to 5 are served. Mr. Shelat, learned advocate has filed appearance for respondent No.3 and Mr. Bhatt, learned advocate, has entered appearance for respondent No.4. The respondent No.5, though served, has not entered appearance. Since, learned advocates for the respondent Nos.3 and 4 are not present when the petition is taken up for hearing, for the present, the proceedings are adjourned to 13.2.2012.
The OL shall examine the record and inform the present status. The OL shall also clarify as to whether any objections pursuant to the advertisement are received or not.
