JUDGMENT / ORDER

This Court (Coram: K.S.Jhaveri, J) vide order dated 12.03.2012 admitted the matter and by way of ad-interim relief qua continuity of service and back wages were stayed.
In response to the notice of rule issued by this Court as aforesaid, Mr.Mishra, learned advocate appears for respondent No.1.
Mr.Munshaw, learned advocate for the petitioners, states that in fact the respondent-workman has already been reinstated. However, Mr.Mishra, learned advocate appearing for respondent No.1-workman, states that the respondent-workman has been reinstated but he has not been permitted to mark his presence in the muster-roll. In reply to the said contention, Mr.Munshaw, learned advocate for the petitioners, on telephone instructions from the Divisional Controller of petitioner No.1-Corporation, states that respondent No.1-workman is a daily wager and he has been given attendance card and hence, the question of his signing in the muster-roll to establish that the respondent-workman has worked for particular day and date may not been necessary.
In view of the above, ad-interim relief to continue as interim relief till the final disposal of the petition.
Mr.Mishra, learned advocate for respondent No.1, desires to file affidavit-in-reply. Same shall be filed on or before 10.05.2012. Rejoinder, if any, to be filed on or before 11.06.2012. Matter to come up on 02.07.2012.
