In view of the office note as well as the order passed by the Division Bench of this Court (Coram : B.J. Shethna & M.C. Patel, JJ.), it transpires that main First Appeal No.1938 of 2004 has been disposed of vide order dated 25.07.2005 and transferred to the District Court, Mehsana as the claim was less than Rs.5.00 lacs in view of the Gujarat Civil Courts Act, 2005, coming into force with effect from 09.05.2005. It also transpires that aforesaid Civil Application No.412 of 2006 for condonation of delay has been filed in June, 2006.
In the circumstances, Civil Application No.412 of 2006 as well as Misc. Civil Application (Stamp) No.408 of 2005 do not survive and stand disposed of accordingly.
