Present Civil Application under Section 5 of the Limitation Act has been preferred by the applicants herein to condone the delay of 406 days caused in preferring the Second Appeal.
Having heard Shri R.M. Chauhan, learned advocate for Shri H.S. Munshaw, learned advocate appearing on behalf of the applicants and Shri Nirav Padhiyar, learned advocate appearing for Shri Kanara, learned advocate appearing on behalf of the respondents and considering the averments in the application in support of the prayer to condone the delay and as sufficient cause has been shown, delay caused in preferring the Second Appeal is hereby condoned. Rule is made absolute accordingly. Registry is directed to notify the main Second Appeal with Civil Application for admission hearing on 30th April 2012.
