Learned counsel Ms.Falguni Patel waived service of rule for the respondent No.1 and learned counsel Ms.Karuna Rahevar waived service of rule for the respondent No.8. Presence of rest of the respondents are not necessary.
[2] The applicant - original claimant seeks disbursement of the compensation amount deposited by respondent No.1 before the Claims Tribunal.
[3] Counsel for the applicant submitted that the respondent No.1 has not deposited full amount as directed by this Court. He further submitted that out of amount of Rs.3,89,000/- so far deposited by the respondent No.1, disbursement may be made in favour of the applicant.
[4] Learned counsel Ms.Falguni Patel for respondent No.1 stated that whatever short fall in the deposit, the Corporation shall deposit before the Claims Tribunal within two months from today.
[5] Out of the amount deposited by the Corporation before the Claims Tribunal, the applicant shall be permitted to withdraw Rs.1,00,000/-. It is made clear that remaining amount shall be invested in any Nationalized Bank. Further amount that may be deposited by the Corporation shall also be similarly invested by the Claims Tribunal in any Nationalized Bank till further orders.
[6] Civil Application stands disposed of. Rule is made absolute.
