JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) We have heard learned advocate Mr.D.G.Shukla for the appellant, learned advocate Mr.Vaibhav A.Vyas for the respondent No.1 and learned AGP Mr.N.J.Shah for the respondent No.2.
Learned advocate Mr.D.G.Shukla shall file an additional affidavit-in-reply bringing on record the basis of fixing 152 qualifying marks for scheduled caste candidates. As the direct recruitment was only on the basis of interview, he shall also bring on record any resolution passed by the Commission under which 152 qualifying marks has been fixed for scheduled caste candidates or other candidates. In the additional affidavit he shall explain the exact basis for fixing 152 qualifying marks. He shall also produce the backlog of scheduled caste candidates and whether the backlog vacancy occurred due to fact that it could not be filled in earlier advertisement or in the earlier advertisement there was no backlog vacancy left and backlog vacancy has been included in this advertisement. Learned AGP Mr.N.J.Shah shall also file an affidavit explaining the same. The Commission shall also file the requisition as well as the copy of advertisement on record and the State Government shall explain how this backlog vacancy occurred.
