Kishor Paul, learned advocate waives service of notice of rule on behalf of respondent-workman.
By way of ad-interim relief, the impugned award is stayed only qua the direction regarding continuity of service. The order of reinstatement shall be implemented within a period of one month from today. In case of failure to reinstate the respondent-workman by the stipulated date, the interim relief shall stand and it will be open to the concerned respondent to initiate proceedings under the provisions of Section 33(C)(2) of the Industrial Disputes Act, 1947 claiming salary as if he is in continued in service.
