(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) 1 The present Application is filed to recall and review the order dated 5.12.2011 passed by this Court in Letters Patent Appeal No. 77 of 2006 and setting aside of the direction regarding the payment.
2 We have heard learned Advocate Mr. M.B. Gandhi for the applicants and Mr. Shalin Mehta learned Advocate for the opponent.
3 The applicant - original respondent has produced a copy of the Service book of the opponent - original appellant for the first time in this Review Application, which is also not complete service book and it does not show as to how much leave was available in the leave account of the appellant for the year 1986, 1988 and 1989 or thereafter. Since the entire service book has not been produced with the review application and the copy of service book produced with the application is also incomplete, we are of the opinion that no error apparent on the face of record had been committed by us in allowing the appeal.
4 In the above view of the matter, the Review Application deserves to be rejected and is accordingly rejected.
