1. By way of this petition, the petitioner has prayed to quash and set aside the judgment and award passed by the Labour Court, Ahmedabad in Reference (LCI DAT) No.68/2006 dated 17.08.2006 whereby, the said reference was rejected.

The facts in brief are that on 07.05.2001 while the petitioner workman was discharging his duties as a Conductor, the bus was checked by the checking squad of the respondent Corporation and it was allegedly found that the petitioner had committed certain irregularities in the issuance of tickets. After following due procedure, the disciplinary authority of the respondentCorporation imposed the penalty of dismissal from service vide order dated 09.12.2002. The first appeal preferred by the petitioner, against the said order, was rejected. Therefore, the petitioner raised a dispute, which, ultimately, culminated into a Reference before the Labour Court. The Labour Court, after considering the evidence on record, rejected the reference. Hence, this petition.
3. Heard learned counsel for the respective parties and perused the documents on record. The petitioner was found guilty of serious irregularities / misconducts on 3 different occasions in the past. He was also found guilty of similar misconduct in the past. Being an employee attached with a public utility sector, the petitioner ought to have discharged his duties honestly and diligently.
4. Considering the facts of the case and the evidence on record, the Labour Court has rightly dismissed the reference of the petitioner. I am in complete agreement with the reasonings given and findings arrived by the Labour Court and find no reasons to interfere with the same.
5. In the result, the petition is dismissed. Rule is discharged, Interim relief if any, stands vacated.
