By way of this petition, the petitioner has challenged the judgement and award of the Industrial Tribunal passed in Reference (IT) No. 220 of 1998 on 10.5.2004 whereby the Tribunal quashed and set aside the order passed by the Reviewing authority imposing penalty of stoppage of three annual increments without future effect and confirmed the order passed by the competent authority imposing penalty of stoppage of six monthly increments without future effect. 2. The facts of the case are that the respondent was working as a driver. When the checking squad checked the bus, it was found that the bus was late and the driver drove the bus without light. After holding departmental inquiry, the competent authority imposed punishment of stoppage of six monthly increments on the respondent. However, the reviewing authority enhanced the punishment and imposed penalty of stoppage of three annual increments without future effect.
3. The respondent raised an industrial dispute against the enhancement of punishment by the reviewing authority which was referred to the Industrial Tribunal by way of Reference (IT) No. 220 of 1998.
4. The Industrial Tribunal, after hearing both sides, passed the award as aforesaid. Hence the petition.
5. Learned counsel for the petitioner has contended that the Tribunal has committed an error in setting aside the order of the reviewing authority and upholding the order passed by the competent authority. Therefore, the order of the Tribunal is required to be quashed and set aside.
6. I have heard learned counsel for the petitioner. I have perused the record of the case. Looking to the past record of the respondent, he has committed only four defaults. Therefore, I am in complete agreement with the view taken by the Tribunal. No interference is called for. This petition is devoid of any merit and dismissed. Rule is discharged. No order as to costs.
