JUDGMENT / ORDER

THE HON’BLE SRI JUSTICE C.V. NAGARJUNA REDDY WRIT PETITION No.22267 of 2014 Dated: 20.11.2014 Between:
M/s. Gujarat Pesticides India Rep. by its Proprietor Devarakonda Venkata Naga Aswani Kumar .. Petitioner and The Commissioner & Director of Agriculture, Andhra Pradesh, and another.
.. Respondents Counsel for the petitioner: None appeared Counsel for the respondents: A.G.P. for Agriculture (A.P.) The court made the following:
ORDER:
This writ petition is filed for a Mandamus to declare the action of the respondents in seeking to interfere with the alleged activities of manufacture and sale of bio-products by the petitioner as illegal and arbitrary.
In the counter-affidavit filed by respondent No.1, it is inter alia stated as under:
“In fact, after filing of the above writ petition, the concerned Mandal Agricultural Officer visited the premises of the petitioner on 22.08.2014. The Inspecting Officers noticed that no raw material was available for preparation of bio-products. The Inspecting Officer also found that no machinery is available for preparation of bio-products except packing and sealing machines. The petitioner firm not even obtained the small scale industry certificate. The Inspecting Officers recorded a Panchanama to the said effect, i.e. the manufacturing unit is not in existence which is filed herewith. Under the said circumstances, the allegations of interference are nothing but false and made for the purpose of the present writ petition.”
No reply-affidavit is filed controverting the above-reproduced averments in the counter-affidavit.
Since the petitioner failed to establish that it has established bio-products manufacturing unit, it is not entitled to any relief.
The writ petition is accordingly dismissed. As a sequel to the dismissal of the writ petition, W.P.M.P.No.27942 of 2014 shall stand disposed of as infructuous.
