JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) 1. We have heard Mr. Manav Mehta, learned counsel for the petitioner. Learned counsel for the petitioner has urged that Clause 61 of the terms and conditions of the tender is arbitrary and lacks bona fide.
2. We cannot interfere with the terms of the tender. We are not inclined nor we can issue any direction to the respondent to include a particular term or delete any term in the tender notice. It is always open to the petitioner to apply in pursuance to the tender, if the conditions suits to him. We do not find any merits in the writ petition. The writ petition is accordingly dismissed.
