JUDGMENT / ORDER

When this matter is called out, no one is present on behalf of the appellant. Learned advocate Mr.Deepak M. Shah for the appellant has addressed a letter dated 20.12.2011 which is on record that the papers have been taken by the appellant in the year 2008 and, thereafter, the appellant has not engaged any other advocate nor he has taken any steps. Under the circumstances, no fresh notice is required to be issued. When the appellant has collected the papers to engage another advocate, he cannot claim that he is ignorant of the matter.
Under these circumstances, as no one is present for the appellant, the present appeal deserves to be dismissed for want of prosecution and accordingly stands dismissed. However, liberty is reserved in case of any difficulty or in case he makes appropriate application which can be considered on merits.
