Respondent Petition under Sections 437 & 439 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to release the petitioners/accused No. 1 to 3 on bail in Crime No. 23 of 2014 of Police Station, Bhupalpally, Warangal District, pending investigation, enquiry and trial;
The petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri P.Prabhakar Reddy, Advocate for the Petitioners and of the Public Prosecutor, for the Respondent, the Court made the following.
ORDER:
“The petitioners are A1 to A3. They seek for grant of bail. They allegedly committed offences under Section 372, 373, 376 and 366-A read with Section 511 IPC as well as under the provisions of the Protection of Children from Sexual Offences Act, provisions of Immoral Traffic (Prevention) Act and the provisions of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act. A4 to A7 were appeared to have been already enlarged on bail. Learned counsel for the petitioners submitted that the petitioners did not commit the offences levelled against them. It is the case of the prosecution that the petitioners forced the victim to indulge in prostitution although the victim is a minor girl. The investigating Agency has examined 16 witnesses so far. In view of the stage of the investigation and in view of the defence of the petitioners, I consider it appropriate to enlarge the petitioners on bail.
Accordingly, this Petition is allowed. The petitioners/A1 to A3 are enlarged on bail on a bond of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties each in a like sum to the satisfaction of learned Judicial Magistrate of First Class, Parkal, Warangal District.
