This Criminal Petition is filed to quash proceedings in CC.No. 367 of 2009 on the file of Judicial Magistrate of First Class, Yellandu, Khammam district for alleged offences under section 420 read with section 109 IPC.
2. Heard both sides.
3. Advocate for petitioner submitted that petitioner is a Government employee and he is unnecessarily implicated in the above referred case.
4. I have perused the charge sheet filed by the police and after examining as many as ten witnesses police found that there is prima facie material against this petitioner also. At this stage, the correctness of statements of witnesses recorded by the Police during investigation cannot be decided. However, taking employment of the petitioner into consideration, I feel that lower court shall be directed to dispose of CC.No. 367 of 2009 as expeditiously as possible within stipulated time.
5. For the above reasons, this criminal petition is disposed of directing the court below to expedite trial of CC.No. 367 of 2009 and dispose it of as expeditiously as possible preferably within six months from the date of receipt of copy of this order and trial court shall consider the grounds urged on behalf of petitioner herein during trial without being influenced by dismissal of this criminal petition.
6. With the above observation, this criminal petition is disposed of.
7. As a sequel, miscellaneous petition, if any, shall stand closed.
