This writ petition is filed for declaring the action of the respondents 1, 2 and 4 in not considering the representation given by the petitioner society dated 24-02-2014 and granting lease of Marripalli Madugu, situated at Vemulapalem village and Ravi Tank situated at Divipalem Panchayat to the petitioner society for the Fasli 1423 (01-07-2013 to 31-06-2014) as illegal, arbitrary and contrary to the guidelines issued in G.O.Ms.No.776, dated 31-12- 1990 and for a consequential direction to the respondent to grant lease of the tanks to the petitioner society.
The grievance of the petitioner is that the petitioner society and the impleaded respondent society fighting for grant of lease of Pedda Cheruvu situated in Guduru Village, Marripalem Madugu, situated in Vemulapalem village and Ravi Tank, situated in Divipalem Panchayat. The petitioner states that since it is existing society, it has to be granted lease for the current fasli 1423 as per the circular issued by the 2nd respondent in Circular Memo No.3228.1.2/92, dated 21-05-1992 as well as G.O.Ms.No.776, dated 31-12-1990, for which the petitioner society made a representation on 21-03-2013 to the 1st respondent, which is pending, but no orders are passed by the 1st respondent till today. Aggrieved by the said inaction, the present writ petition is filed.
Heard the learned counsel for the petitioner and the learned counsel for the impleaded respondent.
Learned counsel for the impleaded respondent states that they also filed a representation on 03-03-2014 for grant of lease in respect of self-same tanks stating that it is registered on 17-02- 2014 and that the lease of the said tanks has to be granted in their society.
Learned Assistant Government Pleader for Fisheries states that the action will be taken as per the circular dated 21-05-1992.
In view of the facts and circumstances stated above, the 1st respondent is directed to dispose of the representation filed by the petitioner dated 21-03-2013 as well as the representation filed by the impleaded respondent dated 03-03-2014 in accordance with law and take appropriate action thereon, as expeditiously as possible, preferably within a period of two (2) weeks from the date of receipt of a copy of the order.
With the above direction, the writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions if any pending shall stand closed.
