. Respondent Petition under Sections 437 & 439 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to enlarge the petitioner on bail in connection with Crime No. 37 of 2014 on the file of the PS., Chebrole, W.G.District.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri B.Vijaysen Reddy, Advocate for the Petitioner and of the Public Prosecutor for the Respondent, the Court made the following.
ORDER:
“The petitioner is A-6. He seeks for grant of bail. He allegedly committed offences under Section 399 IPC. He along with six others was allegedly prepared to commit decoity when he was caught.
The learned counsel for the petitioner submitted that the petitioner is innocent of the offences. He also pointed out that A7 was already enlarged on bail through orders dated 11.4.2014 and submitted that the petitioner stands on the same footing as A7. From the remand report, it appears that the allegations and overt acts against all the accused are identical. They were allegedly attempting to commit decoity and have not committed any decoity. I, therefore, consider it appropriate to enlarge the petitioner on bail. Where the investigation is still in progress, I consider it appropriate to enlarge the petitioner on bail on terms only.
Accordingly, this Criminal Petition is allowed. The petitioner is enlarged on bail on a personal bond of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties in a likesum to the satisfaction of Additional Judicial First Class Magistrate, Tadepalligudem, West Godavari District. After his release, the petitioner shall appear on every Monday, Wednesday, and Friday between 10.00 AM and 6.00 PM before the SHO, Chebrole, West Godavari District, for a period of three months.”
