ORDER:
Heard learned Counsel for the petitioner and learned Standing Counsel appearing for the respondents.
This Writ Petition was filed challenging action of the respondents in inviting tenders for constructing a drainage canal in Ward No. 29 running adjacent to Southern side compound wall of the petitioner’s House bearing No. 11-4-485/8, a t Tarakarama Nagar, 8 Incline colony, Godavarikhani, Ramagundam mandal of Karimanagar District.
This Court by order dated 23.06.2008 granted interim stay with regard to the demolition of compound wall of the petitioner in the process of constructing a drainage which was passing abutting his compound wall. In view of the said interim order, the property of the petitioner is protected and therefore the challenge made by the petitioner to the action of the respondents in inviting tenders does not survive. As such, no further orders are need be passed in the Writ Petition,.
The Writ Petition is therefore closed. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
