Judgment:
With the consent of the learned Counsel for the parties, the Appeal is taken up for hearing and disposal.
This Appeal is filed against judgment and decree, dated 29-01-2003, in OS.No.95 of 2000 on the file of the Court of the learned Principal Senior Civil Judge, Vijayawada.
At the hearing, it has come out that during the pendency of the Appeal, the deceased appellant, before his death, has paid off the entire debt amount. In view of the same, the Appeal is disposed of recording the satisfaction of the decree. The learned Counsel for the respondent-
Bank submitted that as the daughter viz., Ms.Govinda Pratima, whose name is included in the family members details furnished by appellant Nos.2 and 3, has not been impleaded in the Appeal, the respondent- Bank may insist on the consent of the said person for returning the original documents belonging to the deceased appellant.
The learned Counsel for the appellants submitted that he has no information about the existence of the daughter of the deceased appellant and that if such person is in existence, appellant Nos.2 and 3 will obtain her consent for return of the documents.
Subject to the above clarification, the Appeal is disposed of.
