Heard Sri Ishwar Chandra Tyagi, learned counsel for the applicant, the learned A.G.A. and perused the record.
The age of the victim is about 12 years and as per her medical examination report her Labia Majora is red swollen and hymen is ruptured. This indicates that it is a subject matter of sexual assault upon her by the applicant. It is a heinous crime where a minor girl has been used to quench the sexual lust of the applicant. No leniency could be shown to such type of persons. Hence, bail application of the applicant is hereby rejected.
Learned trial court is directed to gear up the matter and make necessary endeavour to conclude the trial as expeditiously as possible.
