JUDGMENT G.P. Srivastva, J.
1. Heard learned Counsel for the applicant and learned A.G.A.
2. The prosecution story shows that on. 30.10.05 at about 2.15 P.M. the victim a married lady had gone to call her son towards jungle. The applicant armed with a country made pistol met her, dragged her in a sugar cane field and committed rape upon her at the point of country made pistol. The victim in her statement under Section 6 Cr.P.C. has narrated the entire story. In the medical report spermatozoa were found present. It is immaterial that no injury was found on her body because she was a grownup married lady and the rape was allegedly committed on the point of pistol. The Doctor has opined that no definite opinion about rape can be given. He did not rule out the possibility of rape. No ground for bail is made out. The bail application is rejected.
