Learned counsel for the petitioners contends that the criminal proceedings have been initiated on account of matrimonial disputes. The petitioner No.1, husband of respondent no.2, would like to go in Mediation and Conciliation Centre of this court for settlement of issues.
I have considered contentions of the learned counsel.
Issue notice to respondent no.2 through Chief Judicial Magistrate, Baranaki, for 18.7.2012.
In the meantime, let a sum of Rs.7,000/-(seven thousand only) be deposited by the petitioner in the Registry of this court within ten days from today.
It is provided that in case, the respondent no.2 agrees to join mediation proceedings, a sum of Rs.5000/-(five thousand only) would be released in her favour and the remaining Rs.2000/-(two thousand only) shall be remitted to the Mediation and Conciliation Centre.
It is further provided that in case money is not deposited within the stipulated time, the interim direction issued today, shall be deemed vacated, without reference to the Court.
Let the respondent no.2 remain present on the date of listing.
No coercive measures would be employed to arrest the petitioner nos.2 and 3 till the next date of listing.
