Heard learned counsel for the applicants, learned AGA for the State/ opposite party nos.1 and 2, Shri Indrakesh Kumar Sharma, learned counsel for the opposite party no.3 and perused the record.
This application under Section 482 CrPC has been filed by the applicants with the prayer to quash the summoning orders dated 06.11.2020 and 10.01.2021 and entire proceedings of Criminal Misc. Case No. 124 of 2020 (Mohd. Israr Ahmad Vs. Roshan and others), under Sections 149, 323, 504, 506 IPC (against the applicant nos. 1 to 4), under Sections 354, 149, 323, 504, 506 IPC and Sections 7/8 of POCSO Act, Police Station Kotwali Khalilabad, District Sant Kabir Nagar, pending in the court of Additional Sessions Judge/ Special Judge (POCSO Act), Sant Kabir Nagar.
At the very outset, learned counsel for the applicants has made a statement at the bar that he does not want to press other prayers made in the application and has confined his prayer only to the relief that in case, applicants appear before the court below and apply for bail, their bail application be considered and disposed of at the earliest.
Per contra, learned AGA has opposed for expeditious disposal of bail application of the applicants.
In view of the above statement, it is directed that if the applicants appear/ surrender before the court below and apply for bail, their prayer for bail be considered and decided expeditiously in accordance with law.
With the aforesaid observations, this application under Section 482 CrPC is finally disposed of.
