ORDER:
Counter is filed by respondent No.3. Petitioners have also filed reply affidavit.
2. After hearing for some time, it is apparent that several contested and disputed questions of fact, particularly, between petitioners and respondent No.3, arise for consideration, which cannot be adjudicated by this Court under Article 226 of the Constitution of India.
3. Learned counsel for the petitioners, therefore, fairly states that the petitioners may be permitted to withdraw the writ petition with a liberty to take such appropriate proceedings, in accordance with law, with regard to the redressal to the grievance of the petitioners against respondent No.3.
Hence, with the liberty aforesaid, the writ petition is accordingly dismissed as withdrawn. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
