The petitioner was aggrieved with the SARFAESI proceedings initiated against the petitioner's property and was before this Court earlier in W.P.(C) No. 3328 of 2014, wherein the petitioner was granted 10 equal instalments starting from 28.02.2014. That has to be effected on or before the last day of each of the succeeding months. The petitioner prays for further indulgence. Insofar as the instalments granted by this Court, any interference made thereon would amount to a review of the judgment of this Court. Nor can equity be extended more than what has been granted in the aforesaid judgment. However, the learned counsel appearing for the respondent Bank submits that with respect to the instalments granted by this Court almost Rs.12,48,000/- is paid as against Rs.13,60,000/- due. W.P.(C) No. 14470 of 2014 2 2. In such circumstance if the deficiency is rectified within one month from today, necessarily the Bank shall not initiate any recovery proceedings. However, the instalment to be paid as on the last working day of the present month also shall be complied with.
The Writ Petition is disposed of.
