JUDGMENT / ORDER

(Judgment of this court was made by K.KALYANASUNDARAM,J.) The appeal suit is directed against the judgment and decree, dated 19.07.2016 passed in O.S.No.204 of 2015 by the 1st Additional District Judge, Madurai.
2.Today When the matter is taken up for hearing, the appellant as well as the respondents with their respective counsel appeared in person before this Court and submitted that the dispute between them has been amicably settled. They have filed a Joint Memorandum of Compromise to that effect, which would run thus:-
5. Now, the parties have amicably settled the matter after negotiations and this memo of compromise is executed and filed before the Honourable Court. The terms and conditions of this memo of compromise are as follows:
(A). The item 1 of the suit properties is situated at Door No.4, Subburaya Vathiyar Lane, South Veli Stree, Madurai Town and measures 672 Square feet.
(B). The item 2 of the suit properties is situated at Door No.9, Subburaya Vathiyar Lane, South Veli Stree, Madurai Town and measures 315 square feet.
(C). Both parties hereby agree that item 1 of the suit properties measuring 672 square feet shall be allotted to the 4/5 share of the respondents jointly.
(D). Both parties hereby agree that item 2 of the suit properties measuring 315 square feet shall be allotted to the 1/5 share of the appellant.
(E). Both parties agree that the appellant shall pay a sum of Rs.1,00,000/- to the first respondent within one month towards owelty.
(F). Both parties agree that the respondents do not have any right, title or interest over the item 2 of the suit properties.
(G). Both parties agree that the appellant does not have any right, title or interest over the item 1 of the suit properties.
(H). Both parties agree that the two sketches drawn in respect of the two schedule of properties shall form part of this compromise memo;
(I). The compromise decree passed in terms of this compromise memo along with the annexed sketches shall be registered by the Joint Sub Registrar No.1, Madurai South.
4.In view of that, the appeal suit is decreed in terms of the Joint Compromise Memo, dated 06.11.2017. The Joint Compromise Memo shall form part of the decree. No Costs. Consequently, connected miscellaneous petition is closed.
