Present writ petition has been filed by the petitioner Gram Shiksha Samitti Gram Panchyat Udhanapur Vikas Khand, Mohammadi, District Lakhimpur Khiri with prayer to issue a writ, order or direction in the nature of certiorari quashing the impugned order dated 8.11.2013 passed by opposite party no.2.
Learned standing counsel has accepted notice for opposite parties no.1 and 2.
Shri Sandeep Yadav has accepted notice for opposite party no.3.
Issue notice to opposite party no.4 by registered post with acknowledgement due.
Steps to be taken within a week.
I have perused the impugned order passed by opposite party no.2. At this stage there appears no sufficient ground to stay operation of the impugned order. The impugned order of opposite party no.2 has been passed on 8.11.2013 and this writ petition has been filed after expiry of about six months.
Therefore, keeping in view of the facts and circumstances of the case, no interim order is required.
Counter affidavit may be filed within four weeks. Rejoinder affidavit may be filed within within two weeks thereafter.
List in the second week of August, 2014 for hearing.
