This is a writ petition of the year 2008. On 5.11.2008, this Court had passed the following order:-
"Vide order dated 21-10-2008, the Court had directed the learned Standing Counsel to obtain instructions fixing 5th November, 2008, when the matter was taken up, the learned standing counsel stated that the instructions has not been come so far.
The contention of the petitioners is that the respondent No. 7 who is a Member of Legislative Assembly of the ruling party is taking steps to dispossess the petitioners from Plot No. 211 Kha and 212 area 6-0-4, which is a land recorded in the name of Junior High School and is being managed by the petitioners.
The learned standing counsel may file counter affidavit within a period of three weeks.
List on 21st December,. 2008.
Rejoinder affidavit may be filed by the next date of listing.
As an interim measure, it is provided that the petitioners shall not be dispossessed from the plot in question except in accordance with law."
This is a writ petition of the year 2008 and still counter affidavit has not been filed by the respondents.
We, therefore, confirm the interim order dated 5.11.2008 and dispose of the writ petition in the light of the interim order dated 5.11.2008.
