JUDGMENT / ORDER

This Criminal Original Petition has been filed seeking a direction to the third respondent to register a FIR on the basis of the private complaint filed by the petitioner, which was forwarded by the learned Judicial Magistrate, Arakkonam in CMP.No.4662 of 2014 dated 25.03.2015.
2. It is the case of the petitioner that due to the property dispute between the parties, the petitioner and his family members were assaulted by one Parwathi and others on 23.01.2012, which compelled him to file a complaint before the third respondent. Pending the same, on 08.7.2014, the petitioner and his family members were again assaulted by the said persons. Since no action was taken on the petitioner's complaint, he has preferred a private complaint under Section 200 Cr.P.C. before the learned Judicial Magistrate, Arakkonam and the same was taken on file as CMP.No.4662 of 2014. By order dated 25.03.2015, the learned Magistrate has forwarded the entire case records filed by the petitioner to the third respondent for further investigation and appropriate action. Even thereafter, no action was taken by the third respondent. Hence, this petition.
3. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor, who took notice for the respondents.
4. Considering the facts and circumstances of the case, this Court directs the third respondent to hold appropriate enquiry on the petitioner's complaint, which was forwarded by the learned Judicial Magistrate, Arakkonam in CMP.No.4662 of 2014 and if the allegations made therein disclose commission of cognizable offence, register a case, investigate the same and file a final report or close the same as the case may be, in accordance with law, as expeditiously as possible.
5. With the above direction, this Criminal Original Petition is disposed of.
