HONOURABLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No. 32538 of 2014 ORDER:
House bearing G.P.No. 5-91 and PJP No.89 belonging to first petitioner and House bearing G.P. No. 5-94 and PJP No. 92 belonging to second petitioner at Anugonda village, Makthal mandal, Mahaboobnagar district was acquired by following due procedure of law contemplated under Land Acquisition Act, 1894 for the purpose of Priyadarshini Jurala Project. Award No. 3of 2012 dated 21.3.2012 was passed fixing the compensation of Rs.5,91,220/- to first petitioner and Rs.6,30,206/- to second petitioner.
Properties and lands of several persons were acquired in similar manner. Some of the oustees claimed for enhancement of compensation. Their claim was referred to Civil Court. In L.A.O.P. No.4 of 2013 and batch, the Senior Civil Judge, Narayanpet, allowed claim for higher compensation. After order passed by the Senior Civil Judge in L.A.O.P No. 4 of 2013, petitioners have applied for redetermination of the compensation under Section 28-A of the Act. The Land Acquisition Officer, vide orders dated 20.12.2013 redetermined the compensation payable in accordance with Section 28-A of the Act. Grievance of the petitioners necessitating institution of this writ petition is, though revised compensation is determined as early as on 20.12.2013, so far the differential amount of Rs.3,49,545/- to first petitioner, Rs.4,12,088/- to second petitioner is not paid and the same is causing undue hardship and suffering to the petitioners.
2. On instructions, learned Assistant Government Pleader for Irrigation submits that respondents require three months time to deposit the amount as determined by the Land Acquisition officer vide order dated 20.12.2013.

Having regard to the fact that the property of the petitioners was acquired in the year 2010 and though Land Acquisition Officer re-determined compensation at higher rate on 20.12.2013, but without any justifiable reason the amount is not paid to the petitioners so far, third respondent is directed to take steps to deposit the amount payable to the petitioners as quantified by the Land Acquisition Officer within eight weeks from the date of receipt of copy of the order and on such deposit, the 4th respondent-Special Deputy Collector (Land Acquisition) is directed to take steps to release the same to the petitioners.
Accordingly the writ petition is disposed of. No Costs. Having regard to the same, all old miscellaneous petitions are closed.
