JUDGMENT / ORDER

(Per : HONOURABLE THE CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) Pursuant to our earlier order dated August 24, 2012, the Gujarat Pollution Control Board (for short 'the GPCB') has today submitted a report. After taking into consideration the water sample from the outlet of two CETPs at Dhareshwar and Jetpur, it appears from the report that so far as Jetpur is concerned, the level of Total Dissolved Solids is 5482, whereas the maximum permissible limit is 2100. Similarly, the amount of Chloride found is 1840, whereas the maximum permissible limit is 1000.
So far as Dhareshwar is concerned, it appears that the Total Dissolved Solids found are 2370 in comparison to the maximum permissible limit of 2100 and there is no other deviation of any other articles.

Raval, learned advocate appearing on behalf of Association, submits that due to scarcity of rain in Jetpur area, the Total Dissolved Solids have been found to be in excess of the maximum permissible limit and the same is the reason also for excess amount of Chloride. In such circumstances, in our view, the GPCB should be directed to give a report after taking into consideration the underground water from different surrounding areas for the purpose of ascertaining whether there is excess Total Dissolved Solids and Chlorides in the underground water level at all.
As suggested by Ms.Raval, learned advocate appearing on behalf of GPCB, the GPCB is directed to test the underground water in the surrounding areas and to give report in respect of underground water on next Wednesday. The GPCB is also at liberty to give expert's opinion for the reason for such excess Total Dissolved Solids or excess amount of Chloride as found in Jetpur area.
The petitioner and other respective respondents are also at liberty to rely upon the expert's opinion for excess amount of Total Dissolved Solids and Chloride.
Let the matter appear on September 05, 2012. The interim order earlier granted to continue till then.
