The convict-prisoner has filed this application praying for further extension of his temporary bail. The applicant was permitted to be released on temporary bail initially from 03rd February, 2013 to 17th February, 2013 pursuant to order dated 21st November, 2012 passed in Criminal Miscellaneous Application No.16251 of 2012. The ground for that, he wanted to treat his ailing mother. Having enjoyed the bail for the said period, on the same ground, another application being Criminal Miscellaneous Application No.2850 of 2013 was filed for extending the period. By order dated 19th February, 2013 this Court extended the temporary bail from 21st February, 2013 to 27th February, 2013.
In the present application, extension is further prayed urging the same ground that the mother is still not cured. From the jail record, it was seen that the applicant has served nearly five months in jail out of total sentence of nine years; still however, considering the ground of ailment of his mother, temporary bail was granted twice. The present application is third one, which cannot be entertained in the facts and circumstances of the case. Therefore, the present application is rejected.
