JUDGMENT / ORDER

1. The present application is filed by applicant convict through his wife Umiyaben Govind Vanzara seeking temporary bail for a period of 30 days on the occasion of 'Babari' ceremony of his son, which is scheduled on 27.05.2012.
2. RULE.
Learned APP Mr. Patel waives service of rule on behalf of respondent
- State.
3. The learned APP made available for perusal the jail remarks. The convict is in jail after being punished for offence under Section 302 read with Section 34 of the Indian Penal Code and under Section 135 of the Bombay Police Act, with life imprisonment, in Sessions Case No.197 of 2011 vide order dated 27.12.2011. He is in jail for two years, nine months and twenty six days. He has not enjoyed any temporary bail, furlough leave and parole leave so far. For the first time, he will be out of jail, if application will be granted. Learned APP Mr. Patel requests this Court that in the event, the Hon'ble Court is inclined to grant this application, some stringent conditions may be imposed.
4. Taking into consideration the jail remarks, there is nothing adverse recorded. Hence, application is allowed. The applicant is, therefore, ordered to be released on temporary bail for a period of 07 (Seven) DAYS from the date of his release on his executing a personal bond of Rs.5,000/- (Rupees Five Thousand Only) before the Jail Authorities on certain conditions that he shall;
a) not leave the State of Gujarat.
b) not indulge in any illegal activity.
c) surrender before the Jail Authorities in time.
d) report to the nearest police station on every alternate day.
5. Rule is made absolute. Direct service is permitted today.
