Heard Sri Sunil Kumar Srivastava, learned counsel for the applicant and learned A.G.A. for the State.
The present application under Section 482 Cr.P.C. has been filed for quashing the charge sheet dated 26.09.2017 along with cognizance order dated 20.09.2017 passed by C.J.M, Muzaffarnagar as well as proceedings of Case No. 13293 of 2017 (State of U.P. Vs. Govind and others), arising out of Case Crime No. 225 of 2016, under Sections- 498-A, 323, 504, 506 I.P.C., Police Station- Mahila Thana, District- Muzaffarnagar, pending in the court of Chief Judicial Magistrate, Muzaffarnagar.
Earlier, this Court vide order dated 13.08.2019 directed the concerned Magistrate to verify the compromise/settlement arrived at between the parties. In pursuant thereof, the Magistrate vide order dated 16.09.2019 has verified the compromise arrived at between the parties. The certified copy of the said order has been appended alongwith supplementary affidavit as Annexure No. S.A. 3.
In view of the above, the aforesaid proceedings are hereby quashed.
The application stands allowed.
