Heard Sri Pramod Kumar Maurya (A.O.R. No.A/P 0476/15) holding brief of Sri Rishikesh Pati Tripathi, learned counsel for the petitioners, Sri T.M. Khan, learned counsel for the respondent no.6 and the learned Standing Counsel for the respondents no.1 to 5.
The petitioners in the writ petition are seeking a direction to the respondents to comply with the orders dated 16.02.2019 and 29.03.2019 passed by the S.D.M., Deoria.
It appears that a complaint was filed by the petitioners against the respondent no.7 alleging that the respondent no.7 had allowed water to drain on the road on which an order was also passed by the S.D.M. on the above two dates but it is stated that till date nothing has been done.
No useful purpose would be served by keeping this writ petition pending.
This writ petition is, therefore, disposed of with the consent of the learned counsel for the parties with a direction to the respondent no.3, S.D.M., Tehsil Deoria, District Deoria to examine the matter and take appropriate conclusive decision with regard to his own order dated 16.02.2019 and 29.03.2019 in accordance with law within a period of one month from the date a certified copy of this order is received in his office.
It is made clear that the Court has not adjudicated the claim of the petitioners on merits.
