Heard learned counsel for the petitioner and the learned Standing Counsel appearing for the State-respondents.
Vide order dated 6.2.2020 notices were issued to the respondents no.3,4 and 6. Seen the office report dated 6.2.2020. It appears that though the notices have duly been sent through R.P.A.D. but neither the acknowledgement nor undelivered cover has been returned back. In view of the same, notices deemed to be served upon the respondents.
The petitioner has prferred the present petition under Article 227 of the Constitution of India, inter alia, with the following prayer:
"I. Issue direction, directing /commanding to the Court of Uppar Civil Judge (J.D.), Court No.-24 Deoria to decide the execution case no.-1 of 2012 (Govind Ji Mishra vs. DIOS, Deoria & Others), as possible as earliest within a stipulated period."
It is argued by learned counsel for the petitioner that since the matter is pending consideration before the court below for a long time he is suffering irreparable loss.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the court below to consider and decide the aforesaid suit in accordance with law, most expeditiously and preferably within a period of six months from the date of production of self attested computer generated copy of this order downloaded from the official website of High Court Allahabad but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
