The grievance arises under the Andhra Pradesh Scheduled Areas Land Transfer Regulation Rules 1969 (for short ‘the Rules). The 4th respondent filed petition in Case No.1559/93/MNGR before the 2nd respondent under Rule 7 (1) and (2) of the Rules for restoration of possession against the petitioner. The 2nd respondent ordered ejectment of writ petitioner on 19.08.2005 and the learned counsel for the petitioner submits that the copy of the said ejectment order was received by his client on 26.12.2005. The order of ejectment is an appealable order. On 10-01-2006, the appeal was filed before the 1st respondent. The complaint of the petitioner is two-fold, namely that no order on the stay petition moved by the petitioner was passed, much less the appeal was taken up for hearing and disposed of. The order of ejectment and imminent threat of dispossession from petition land was staring at the writ petitioner, he was constrained to file the present writ petition.
This Court, through order dated 08.06.2006, directed status quo obtaining as on that date as to the nature and possession of property shall be maintained. On 04.09.2006, the interim order was extended until further orders. In spite of receipt of notice, the respondents neither filed a counter affidavit nor instructed the learned Government Pleader. Without expressing any view on merits, I direct the 1st respondent to dispose of the appeal presented on 10.01.2006 within a period of three (3) months from the date of receipt of a copy of this order. The interim order granted on 08.06.2006 shall be in force till the disposal of the appeal.
The Writ Petition is accordingly disposed of. No order as to costs.
Consequently, miscellaneous petitions, if any, pending in the Writ Petition shall stand closed.
