At the very outset, learned counsel for the applicant submitted that in this case, charge sheet has been submitted under sections 376-D, 342, 506 IPC and section 3(2)V of SC/ST Act, police station Gabhana, district Aligarh, therefore against the bail rejection order dated 15.03.2021 passed by Special Judge, (SC/ST Act), Aligarh, the appeal is maintainable, and he may be permitted to withdraw this bail application with liberty to file appeal before the appropriate Bench.
In view of statement made by Mr. Ramanuj Tripathi, learned counsel for the applicant, this bail application is rejected as withdrawn with liberty to file appeal before the appropriate Bench.
