ORDER:
The petitioner questions the notice issued by the Tahsildar, Mahaboobnagar Mandal & District, third respondent herein, in Case No.G/1620/2014, dated 14.04.2014. By the aforesaid notice, the bore-well stated to have been dug by the petitioner in Sy.No.175 o f Obulapally village was directed to be stopped its operation after harvesting the existing paddy crop and the third respondent-Tahsildar would conduct an enquiry in the matter. The petitioner questions the same in the Writ Petition on the ground that the third respondent has not conducted any enquiry. However the notice itself says that the Tahsildar would conduct an enquiry and the petitioner was directed to stop the operation of the bore-well after harvesting the existing paddy crop. Admittedly the petitioner has harvested the existing crop and submitted explanation on 01.08.2014 in response to the aid notice. Hence, I am of the view that interdicting of the third respondent to conduct enquiry is not called for and it would be just and appropriate to direct the third respondent to consider the petitioner’s explanation submitted on 01.08.2014 and other attending circumstances and pass appropriate final order with reference to the notice dated 14.04.2014.
With the above observation, the Writ Petition is disposed of at the admission stage. Miscellaneous petitions pending consideration if any shall stand closed. No costs.
