JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) THURSDAY, THE FOURTH DAY OF SEPTEMBER TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.25965 of 2014 BETWEEN B. Bheemaiah.
AND ... PETITIONER The Government of Telangana, Rep. by its Principal Secretary, Revenue Department, Secretariat, Hyderabad and two others.
...RESPONDENTS Counsel for the Petitioner: MR. M. DAMODAR REDDY Counsel for the Respondents: GP FOR REVENUE The Court made the following:
ORDER:
The order impugned is one referable to Section 6 of the A.P. Land Encroachment Act, 1905 (for short ‘the Act’) and the said order appears to have been passed after giving notice to the petitioner under Section 7 of the Act and after considering his explanation.
Since the impugned order is clearly appeallable under Section 10 of the Act, I am not inclined to entertain the writ petition.
2. Though the impugned order is dated 23.01.2014, petitioner states that it was served on him on 13.08.2014. In view of that, to enable the petitioner to avail the appellate remedy, the impugned order shall remain stayed for a period of one week within which time the petitioner shall approach the appellate authority seeking redressal of his grievance.
The writ petition is disposed. As a sequel, miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
VILAS V. AFZULPURKAR, J September 4, 2014 DSK
