(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) After hearing learned counsel for the parties and after going through the materials on record, we are of the view that for effective adjudication of the main Public Interest Litigation, the presence of the applicant is necessary.
We, therefore, allow this application. The applicant is directed to be joined as additional respondent in WP [PIL] No. 165 of 2011.
The petitioner is directed to implead the applicant as additional respondent and serve a copy of the writ-application along with all annexures upon the learned advocate for the applicant. Copy of Civil Applications, if any, be also served on the learned advocate for the applicant.
Affidavit-in-reply to the main writ-application, if any, be filed within a week. Rejoinder, if any, be filed within a week thereafter.
Let the main matter, WP [PIL] No. 165 of 2011, appear on April 5, 2012.
This application stands allowed accordingly. No costs.
