2. We admit the appeal. Learned counsel for the writ petitioner/respondent, after arguing for some time, submitted that the judgment and order of the learned trial Judge may be set aside and the writ petition may be ordered to be dismissed as being withdrawn with liberty to file a fresh proceeding in accordance with law, as may be advised. To this submission, the learned counsel for the State/appellants does not raise any objection.
3. We therefore set aside the judgment and order of the learned trial Judge and dismiss the writ petition as being withdrawn with liberty to take steps in accordance with law, as may be advised, as the appeal is a continuation of the writ petition. The writ appeal is accordingly allowed. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
