Heard learned counsel for the petitioner and Sri S.B. Pandey, learned A.S.G. of India assisted by Sri Varun Pandey, learned counsel for the Union of India.
By means of the present writ petition, a challenge has been made to the order of dismissal dated 15.04.2019, passed by the respondent No. 4/Commandant Office, Unit Head Quarters, 71 BN SSB, Mothiari Camp at Piprakothi, Post- Pipra Factory, Police Station, Piprakothi, District- East Champaran, State- Bihar.
Sri S.B. Pandey, learned A.S.G. of India assisted by Sri Varun Pandey, learned counsel for the Union of India raised a preliminary objection regarding maintainability of the writ petition on the ground of territorial jurisdiction of this Court as also availability of a remedy of appeal under Rule-29 of Rule-29 of Sashastra Seema Bal Rules, 2009, which is a statutory remedy.
The aforesaid could not be disputed by the learned counsel for the petitioner.
In view of the aforesaid, this Court is not inclined to entertain this writ petition. It is accordingly dismissed, however, with liberty to the petitioner to approach appropriate forum, as aforesaid.
